These Terms of Service (“Terms”) govern your access to and use of Passport Photo Rescue, including our website, mobile web application, upload tools, photo analysis tools, photo formatting tools, downloadable files, print-ready files, and related services (collectively, the “Service”).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Important Notice
The Service helps users prepare passport-style and identity-document photos. We are not a government agency, passport office, visa office, immigration authority, consulate, embassy, acceptance facility, printer, retailer, or official photo approval service.
We do not guarantee that any photo will be accepted.
Final acceptance or rejection of a photo is determined by the relevant government agency, issuing authority, acceptance agent, or reviewer.
2. Minimum Age; Authority to Agree
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to create an account, make a purchase, or use the Service.
By using the Service, creating an account, uploading a photo, making a purchase, or accepting these Terms, you represent that:
- you are at least 18 years old or the age of majority in your jurisdiction, whichever is higher;
- you have the legal capacity to enter into these Terms;
- you are not prohibited from using the Service under applicable law; and
- if you use the Service on behalf of another person, including a child or minor, you have the legal authority and consent required to do so.
The Service is not intended to be used directly by minors. A parent, legal guardian, or other authorized adult may use the Service to prepare a photo of a child or minor, subject to these Terms.
If we believe that a minor has created an account, made a purchase, or used the Service directly without appropriate authorization, we may suspend or terminate access, delete associated information, and take any other action we consider appropriate, subject to applicable law.
3. U.S.-First Service Scope
The Service is currently designed primarily for United States passport-style photo workflows, including U.S. 2x2 inch photo formatting and related published photo requirements.
The Service may support or display additional use cases, such as baby passport photos, rejected photo rescue, USCIS-style photos, visa photos, or print-ready outputs. Unless expressly stated otherwise, these features are provided as best-effort assistance based on published requirements and are not official approvals.
If you use the Service for any non-U.S. document, visa, immigration, or identity-photo purpose, you are responsible for confirming the current requirements that apply to your specific application.
4. What the Service Does
Depending on the product or flow you select, the Service may:
- analyze an uploaded photo;
- detect whether a face is present;
- estimate head size, face position, crop, framing, background, lighting, shadows, pose, or other visible characteristics;
- provide likely compliance feedback;
- provide retake or adjustment guidance;
- crop, resize, align, or format the photo;
- generate a digital 2x2 image;
- generate a print-ready 4x6 sheet; and
- help you download or use the resulting files.
The Service is a compliance-assistance and formatting tool. It is not an official validation service.
5. No Guarantee of Acceptance
We work to help you prepare a photo that appears to meet selected published requirements. However, we do not and cannot guarantee that any passport office, government agency, immigration authority, acceptance facility, consulate, embassy, online portal, print provider, or other reviewer will accept your photo.
A photo may be rejected even if the Service indicates that it looks acceptable.
Reasons for rejection may include, without limitation:
- reviewer discretion;
- changed or differently interpreted rules;
- poor print quality;
- upload compression;
- paper or ink issues;
- image distortion after download, upload, or printing;
- inaccurate information selected by the user;
- hidden defects not detected by the Service;
- agency-specific requirements;
- application-specific requirements; or
- other factors outside our control.
You are responsible for reviewing the final image before using it, printing it, uploading it, submitting it, or relying on it.
6. Best-Effort Compliance Checks
Our compliance checks are best-effort, automated, and informational.
We may check the photo against selected published requirements, including size, head position, background, lighting, shadows, face visibility, expression, pose, and framing.
However:
- we may not detect every problem;
- we may incorrectly flag a photo as problematic;
- we may incorrectly indicate that a photo appears acceptable;
- published requirements may change;
- government reviewers may apply requirements differently; and
- some requirements may depend on facts we cannot determine from the image alone.
Any “pass,” “likely pass,” “looks acceptable,” “confidence,” “warning,” or similar message is only an estimate. It is not official approval.
7. AI, Automation, and Photo Processing
The Service may use automated, AI, machine-learning, computer-vision, image-processing, or other non-deterministic systems.
Our intended processing is limited to compliance assistance and formatting, such as crop, sizing, layout, background evaluation, and conservative background preparation where offered.
The Service is not intended to beautify, retouch, reshape, or enhance your appearance.
However, automated systems are not perfect. Processing may unintentionally alter, soften, distort, remove, add, recolor, or otherwise affect parts of the image, including the portrait, face, hair, clothing, shoulders, body edges, shadows, lighting, or background.
You must carefully inspect the final image before using it. Do not use the image if it appears inaccurate, distorted, misleading, unnatural, or otherwise unsuitable.
8. Background Handling
Some Service features may analyze, clean, normalize, replace, or otherwise adjust the photo background.
Background handling is intended to help with formatting and visible background requirements. It is not intended to alter the person in the photo.
Because background processing may affect edges, hair, clothing, shadows, or nearby portrait areas, you are responsible for reviewing the final image carefully before printing or submission.
If the processed result appears to alter the person’s appearance, you should not use it.
9. Face Geometry, Biometric Processing, and Consent
To provide the Service, we may analyze facial geometry and other visible characteristics of the uploaded image. This may include detecting the face, locating facial landmarks, estimating head size, measuring face position, checking eye or head alignment, and evaluating other image characteristics needed for photo validation and formatting.
By uploading a photo and using the Service, you consent to our collection, processing, analysis, and use of facial geometry and related image-derived information for the purpose of providing the Service, including photo analysis, compliance checks, crop guidance, output generation, fraud prevention, security, support, and service improvement as described in our Privacy Policy.
If you upload a photo of another person, including a child, you represent that you have the legal authority and consent required to do so.
We do not claim that our analysis is biometric identification. We do not need to identify you by name to provide the Service. However, some laws may treat face geometry, face scans, or related image-derived data as biometric information.
Our Privacy Policy explains how we collect, use, store, share, and delete photos, facial geometry data, biometric information where applicable, and related records.
You should not use the Service if you do not consent to this processing.
10. Children’s Photos
A parent, legal guardian, or other authorized adult may use the Service to prepare photos of babies, children, or minors.
By uploading a child’s photo, you represent that:
- you are the child’s parent or legal guardian, or you have appropriate authority;
- you consent to the processing of the child’s photo and related image analysis;
- you will review the final image before use; and
- you are responsible for deciding whether the final image is appropriate for submission.
11. User Responsibilities
You are responsible for:
- uploading a photo you have the right to use;
- selecting the correct document type, country, agency, or photo format;
- confirming the current requirements for your application;
- reviewing all warnings, guidance, and output files;
- checking the final image before printing, uploading, or submitting it;
- ensuring the image accurately represents the person photographed;
- ensuring the image is not false, misleading, fraudulent, or impermissibly altered;
- following all instructions from the relevant issuing authority;
- submitting your application correctly and on time;
- maintaining your own copies of files you need; and
- deciding whether to use or reject the final output.
You may not use the Service to create or submit any false, misleading, fraudulent, deceptive, unlawful, or unauthorized photo.
12. Money-Back Guarantee
We offer a limited money-back guarantee for eligible purchases.
If a photo generated by the Service is rejected by the relevant U.S. passport authority or other supported issuing authority specifically because the photo failed to meet the published photo-compliance requirements for the document type you selected, you may request a refund of the amount you paid to us for that photo.
To request a refund, contact us at support@inbound.passport-photo-app.dacontext.ai within 60 days of purchase and provide:
- the email address or order identifier used for purchase;
- the final image generated by the Service;
- the rejection notice, rejection message, or other available evidence showing the photo-compliance reason for rejection; and
- any other information reasonably needed to evaluate the request.
The refund guarantee applies only to the amount paid to us for the applicable photo product.
The guarantee does not cover:
- government fees;
- passport fees;
- visa fees;
- application fees;
- appointment costs;
- printing costs;
- shipping costs;
- travel costs;
- missed flights;
- missed appointments;
- lost opportunities;
- third-party fees;
- lost time;
- emotional distress;
- consequential damages; or
- indirect losses of any kind.
We may deny a refund if:
- the rejection was unrelated to photo compliance;
- you selected the wrong document type, country, agency, or format;
- you edited, compressed, resized, re-cropped, filtered, scanned, printed, or uploaded the image in a way that affected compliance;
- the issue was caused by printer, paper, ink, retailer, upload, scanning, or submission problems outside our control;
- you did not follow instructions shown by the Service;
- the image you submitted was not the final image generated by the Service;
- the request is fraudulent, abusive, incomplete, or unsupported; or
- the request is submitted after the refund period.
At our discretion, we may offer reprocessing, a corrected file, support, or a refund.
13. Third-Party Printing and Retailers
The Service may generate files suitable for standard photo printing, including 4x6 print sheets. The Service may also link to, redirect to, or provide instructions for third-party retailers, print providers, or fulfillment services.
Unless expressly stated in writing, we do not have an official passport-photo approval relationship with any retailer or print provider.
If you print through Walgreens, CVS, Walmart, or another retailer, you are ordering a standard photo print unless the retailer separately states otherwise. The retailer is not validating your passport-photo compliance on our behalf.
We are not responsible for third-party services, including:
- store availability;
- pickup times;
- print quality;
- paper quality;
- cropping or scaling by the retailer;
- color output;
- checkout errors;
- delivery delays;
- retailer pricing;
- retailer refunds;
- retailer privacy practices; or
- retailer terms.
Same-day pickup, where available, is determined by the retailer and store location. We do not guarantee same-day pickup.
14. Payments
Prices are shown before purchase. You agree to pay all charges shown at checkout, including applicable taxes and fees.
Payments may be processed by third-party payment providers. We do not control all payment processing systems and are not responsible for payment provider delays, failures, or errors.
Except as stated in the Money-Back Guarantee section or as required by law, purchases are non-refundable.
15. Accounts, Guest Sessions, and File Access
You may be able to use some parts of the Service as a guest. Certain features may require an email address, login, payment, or account.
You are responsible for maintaining access to your email, account, downloaded files, and order information.
Purchased generated files are available for download for 1 year after purchase, unless you delete your account or request deletion earlier. After that download window ends, we may delete the generated files or make them unavailable, subject to our Privacy Policy.
We may suspend or terminate access to the Service if we believe you have violated these Terms, misused the Service, attempted fraud, abused refunds, infringed rights, or used the Service unlawfully.
16. Photo Rights and User Content
You retain ownership of photos and other content you upload.
You grant us a limited license to host, upload, download, store, copy, process, analyze, modify, display, transmit, and create output files from your uploaded content as necessary to provide, maintain, secure, support, and improve the Service, subject to our Privacy Policy.
You represent that you have all rights and permissions necessary to upload and process the photo.
You may not upload content that is unlawful, infringing, fraudulent, abusive, exploitative, or that you do not have the right to use.
17. Privacy
Our collection, use, retention, deletion, and sharing of personal information is described in our Privacy Policy.
Photos, facial geometry, biometric information where applicable, and identity-document-related images may be sensitive. You should only upload photos that you are comfortable having processed by the Service and its service providers as described in our Privacy Policy.
The Privacy Policy should be read together with these Terms.
18. Prohibited Uses
You may not use the Service to:
- create fraudulent, deceptive, or misleading identity-document materials;
- impersonate another person;
- alter a person’s appearance in a way intended to deceive an authority or reviewer;
- create, support, or submit unlawful applications;
- violate passport, visa, immigration, or identity-document rules;
- upload content you do not have the right to use;
- bypass payment, access controls, security controls, or rate limits;
- scrape, reverse engineer, overload, attack, or interfere with the Service;
- resell or commercially exploit the Service without written permission; or
- use the Service for unlawful, abusive, or harmful purposes.
19. Service Availability and Changes
We may change, suspend, discontinue, limit, or update the Service at any time.
We may change features, algorithms, supported document types, pricing, workflows, output formats, or requirements.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.
20. Disclaimers
The Service is provided “as is” and “as available.”
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and acceptance by any issuing authority, retailer, printer, or third party.
We do not warrant that:
- any photo will be accepted;
- any compliance check will be complete, accurate, or error-free;
- any automated edit will be perfect;
- any background adjustment will leave the portrait completely unchanged;
- any output will meet every requirement that may apply to your situation;
- any retailer will print the image correctly;
- any issuing authority will apply its rules consistently; or
- the Service will prevent application delays, rejection, or additional costs.
Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.
21. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost opportunities, missed travel, missed flights, missed appointments, application delays, rejected applications, government fees, passport fees, visa fees, printing costs, shipping costs, travel costs, third-party charges, or emotional distress.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to us for the specific photo or order giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or rights that cannot be waived under applicable consumer protection law.
22. Indemnification
You agree to defend, indemnify, and hold harmless DACONTEXT, INC., its officers, directors, employees, contractors, service providers, affiliates, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- your use or misuse of the Service;
- your uploaded content;
- your violation of these Terms;
- your violation of law;
- your violation of any third-party rights;
- your submission or use of any photo generated through the Service; or
- your use of the Service for another person, including a child or minor.
This obligation applies to the extent permitted by law.
23. Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights and governs how disputes between you and DACONTEXT, INC. will be resolved.
23.1 Informal Resolution First
Before either you or DACONTEXT, INC. files any claim, lawsuit, arbitration, or other legal proceeding, the party raising the dispute must first try to resolve the dispute informally.
To start informal resolution, you must send a written notice to:

Your notice must include:
- your full name;
- the email address or account associated with your use of the Service;
- a description of the dispute;
- the order number or transaction information, if applicable;
- the specific relief you are requesting; and
- enough information for us to evaluate the issue.
If DACONTEXT, INC. has a dispute with you, we will send notice to the email address associated with your account, order, or use of the Service.
The parties will have 30 days from receipt of the notice to try to resolve the dispute informally. Neither party may start arbitration or file a court action until this 30-day informal resolution period has ended, except for claims seeking emergency injunctive relief or claims that qualify for small claims court.
23.2 Agreement to Binding Individual Arbitration
Except as provided below, you and DACONTEXT, INC. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, your use of the Service, any photo, output, purchase, refund request, communication, privacy-related claim, advertising claim, or relationship between you and DACONTEXT, INC. will be resolved by binding individual arbitration, rather than in court.
This includes claims based on contract, tort, statute, fraud, misrepresentation, consumer protection law, privacy law, biometric privacy law, unfair competition law, negligence, product liability, warranty, or any other legal theory.
The arbitrator will have the authority to award the same individual damages and individual relief that a court could award, subject to these Terms and applicable law.
23.3 Arbitration Provider and Rules
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except as modified by these Terms.
If AAA is unavailable or unwilling to administer the arbitration, the parties will agree on another neutral arbitration provider. If the parties cannot agree, a court of competent jurisdiction may appoint an arbitration provider.
The AAA rules are available at www.adr.org.
23.4 Arbitration Location and Format
Unless the parties agree otherwise, arbitration will be conducted remotely by video conference, telephone, or written submissions.
If an in-person hearing is required, it will take place in San Francisco County, California, unless applicable law requires a different location.
23.5 Small Claims Court Exception
Either you or DACONTEXT, INC. may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.
Small claims court proceedings may be brought in San Francisco County, California, or in another location permitted by applicable law.
23.6 Injunctive Relief Exception
Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property rights, confidential information, security, privacy, or unauthorized access to the Service.
Seeking such relief does not waive the right to arbitration for other claims.
23.7 Class Action and Representative Action Waiver
You and DACONTEXT, INC. agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, claimant, class member, or representative in any class action, collective action, consolidated action, private attorney general action, representative action, or similar proceeding.
The arbitrator may not preside over any class, collective, consolidated, private attorney general, or representative proceeding.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim.
To the maximum extent permitted by law, you and DACONTEXT, INC. waive any right to a jury trial and any right to participate in a class action, class arbitration, collective action, consolidated action, private attorney general action, or representative action.
23.8 Mass Arbitration Procedures
If 25 or more similar arbitration demands are filed against DACONTEXT, INC. by the same or coordinated counsel, or are otherwise coordinated, the disputes will be treated as “Mass Arbitration” demands.
For Mass Arbitration demands, the parties agree to use reasonable batching, bellwether, mediation, or other procedural mechanisms adopted by the arbitration provider to promote efficient resolution and avoid unfair or abusive filing-fee pressure.
The arbitration provider may apply supplemental mass arbitration rules where available and consistent with applicable law.
23.9 Arbitration Fees
Payment of arbitration fees will be governed by the applicable arbitration provider’s consumer rules and applicable law.
If required by law, DACONTEXT, INC. will pay the portion of arbitration fees that the law requires it to pay.
The arbitrator may award fees or costs to the extent permitted by applicable law, the arbitration rules, or these Terms.
23.10 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to:
support@inbound.passport-photo-app.dacontext.ai
Your opt-out notice must include:
- your full name;
- the email address associated with your account or purchase;
- a clear statement that you want to opt out of the arbitration agreement in these Terms; and
- the date.
Your opt-out notice must be sent within 30 days after the date you first accepted these Terms or first used the Service, whichever is earlier.
If you validly opt out, neither you nor DACONTEXT, INC. will be required to arbitrate disputes under this Section 23. All other parts of these Terms will continue to apply.
23.11 Severability
If any part of this Section 23 is found to be invalid or unenforceable, the remaining parts will remain in effect, except as follows:
If the class action waiver, collective action waiver, private attorney general waiver, or representative action waiver is found to be invalid or unenforceable with respect to a particular claim or request for relief, then that claim or request for relief must be brought in court and not in arbitration, but only to the extent required by law.
All other claims or requests for relief will remain subject to arbitration.
23.12 Survival
This Section 23 survives termination of these Terms, termination of your account, deletion of your account, completion of a transaction, refund, chargeback, or your ceasing to use the Service.
24. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where applicable consumer protection law requires otherwise.
For any dispute that is not subject to arbitration under Section 23, the exclusive venue will be the state or federal courts located in San Francisco County, California, except where applicable law gives you the right to bring claims elsewhere.
You and DACONTEXT, INC. consent to personal jurisdiction in those courts for disputes not subject to arbitration.
25. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date.
Your continued use of the Service after updated Terms are posted means you accept the updated Terms.
